Mike Norris and Melissa Hillman successfully defended a local School District, a principal and a teacher against recent claims of student-on-student bullying and sexual harassment asserted by a student pursuant to Title IX of the Education Amendments Act of 1972 and the Fourteenth Amendment to the United States Constitution.

Mr. Norris and Ms. Hillman filed a Motion for Summary Judgment on behalf of the Defendants in the United States District Court for the District of Kansas, arguing that the Plaintiff could not meet his burden of proof under either Title IX or the Fourteenth Amendment.   Judge J. Thomas Marten agreed, and in granting the Motion for Summary Judgment, ruled that the School District and its employees had not acted with deliberate indifference, nor had the individual Defendants treated Plaintiff’s complaint of harassment differently than other complaints based on his gender.  The Defendants prevailed on the Plaintiff’s claims in their entirety.
